These Terms of Use ("Terms") govern your access to and use of Postiz ("the App"), a social-media content scheduling and analytics service available at https://postiz-coolify-oracle.13101993.xyz ("the Service"). By creating an account or using the Service you agree to be bound by these Terms.
By accessing or using the Service you confirm that you are at least 13 years of age (or 16 where required by local law), that you have the legal capacity to enter into a binding agreement, and that you agree to comply with these Terms. If you do not agree, you must not use the Service.
Postiz is a social-media content scheduling and publishing platform for educators and creators who publish learning content to their own social-media accounts. It allows authorised users to:
The Service is provided for personal or internal business use by invited users only. Public registration may be disabled. Access is granted at the discretion of the operator.
When you connect a third-party social media account (e.g. TikTok) you authorise the Service to act on your behalf as permitted by the scopes you approved in the OAuth flow. Specifically:
You may disconnect any social account at any time via Settings → Connected Accounts.
You agree not to use the Service to:
You retain ownership of all content you create and upload to the Service ("User Content"). By uploading content you grant us a limited, non-exclusive, royalty-free licence to store and process that content solely to provide the Service to you. This licence terminates when you delete the content or your account.
You represent and warrant that you own or have the necessary rights to all User Content and that it does not infringe any third-party rights.
Postiz is operated by the app owner and is built on Postiz, an open-source project licensed under the Apache 2.0 licence. The operator makes no claim to ownership of the upstream Postiz software. All trademarks and brand names (including "TikTok") remain the property of their respective owners.
Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference.
We do not guarantee uninterrupted or error-free operation of the Service. We reserve the right to modify, suspend, or discontinue the Service at any time with reasonable notice where practicable. We will not be liable to you for any such modification, suspension, or discontinuation.
The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will meet your requirements or that it will be free from errors or viruses.
To the maximum extent permitted by applicable law, the operator shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Service, including loss of data, revenue, or profits, even if advised of the possibility of such damages. Our total aggregate liability for any claim arising out of or related to these Terms shall not exceed the amount you paid to us in the twelve months preceding the claim (or €50 if no amounts were paid).
You agree to indemnify and hold harmless the operator and its agents from any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising out of your use of the Service, your User Content, or your violation of these Terms or applicable law.
We reserve the right to suspend or terminate your access to the Service at any time, without notice, if we believe you have violated these Terms. You may terminate your account at any time by contacting admin@13101993.xyz. Upon termination, your data will be handled as described in the Privacy Policy.
These Terms are governed by and construed in accordance with the laws of the European Union and, where applicable, the laws of the Federal Republic of Germany, without regard to conflict-of-law principles. Any disputes shall be subject to the exclusive jurisdiction of the competent courts of Germany, unless mandatory consumer protection law in your country of residence provides otherwise.
We may update these Terms from time to time. We will notify you of material changes by email or by posting a notice on the Service. Continued use after the effective date of any revision constitutes your acceptance of the updated Terms.
